أصدرت المحكمة الدستورية، الأربعاء، حكما يقضي بعدم قبول الطعن المقدم بعدم دستورية المادة (191) من قانون الأحوال الشخصية رقم (15) لسنة 2019.

وعلَّلت المحكمة حكمها لعلة عدم اتصال المحكمة الدستورية بالدعوى اتصالا موافقا للدستور والقانون، تأسيسا على أن محكمة الموضوع قد نأت بنفسها عن بحث جدية الدفع بعدم الدستورية، وفقا لما استقر عليه الفقه والقضاء الدستوري فجاء قرارها بالإحالة قاصرا عن تحقيق غايته باتصال المحكمة بالدعوى.
