قال مصدر قضائي مسؤول لدى محكمة أمن الدولة إنه في حال ثبوت تهمة القيام بأعمال من شأنها تعريض سلامة المجمتع وأمنه وتعريض الموارد الاقتصادية للخطر بوصفها جريمة اقتصادية بالاشتراك، التي يشترك فيها المتهمون الستة في قضية "مصانع الدخان" فإن العقوبة قد تصل إلى 20 عاماً اشغال شاقة مؤقتة.

وتأتي التهمة استناداً لإحكمام المادة (2) وبدلالة المادة (7/و و7/ط)من قانون منع الارهاب رقم 55 لسنة 2006 وتعديلاته وبدلالة المادة (3) من قانون الجرائم الاقتصادية رقم 11 لسنة1993 وتعديلاته.
