«الدستورية» ترد طعنًا بالمادة 191 من قانون الأحوال الشخصية

ردت المحكمة الدستورية طعنا بعدم دستورية المادة 191 من قانون الأحوال الشخصية رقم 15 لسنة 2019 لعدم استيفاء الشروط الشكلية الخاصة بالوكالة.

وبينت المحكمة في قرارها الذي أصدرته اليوم الخميس، إن عدم قبول الطعن المقدم بعدم دستورية المادة (191) من القانون جاء لعلة عدم مراعاة الشروط الشكلية في تقديم الطعن بعدم الدستورية لعدم صحة الوكالة التي استند إليها الطاعن لغايات الدفع بعدم الدستورية.

وأضافت إن الوكالة لم تتضمن تفويض الوكيل بتقديم الدفع بعدم الدستورية وبالتالي يصبح الطعن مقدم ممن لا يملك حق تقديمه.
