حكمت محكمة الاستئناف الاتحادية الأميركية في مدينة بوسطن بأنه لا يجوز لإدارة الرئيس دونالد ترامب حجب الجنسية عن الأطفال المولودين لأشخاص يقيمون في البلاد بشكل غير قانوني أو مؤقت.

وأصبحت هيئة مؤلفة من 3 قضاة في محكمة الاستئناف الأميركية الأولى، الجمعة، خامس محكمة اتحادية منذ شهر يونيو تصدر أو تؤيد أوامر بمنع تنفيذ أمر الرئيس، الذي كان يستهدف إنهاء منح الجنسية تلقائيا لهؤلاء الأطفال بعد ولادتهم.

وخلصت المحكمة إلى أن من المرجح أن ينجح المدعون في ادعائهم بأن الأطفال المذكورين في الأمر مؤهلون للحصول على الجنسية بالولادة بموجب بند الجنسية في التعديل الرابع عشر للدستور الأميركي.
